Please read these Terms & Conditions carefully before engaging Legacy Restoration WI for any services. By requesting a quote, signing a service agreement, or allowing work to begin on your property, you agree to be bound by these terms.
Section 01
Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Legacy Restoration WI ("Company," "we," "us," or "our"), a restoration contractor operating in the state of Wisconsin.
By scheduling services, signing an estimate or contract, providing verbal or written authorization to proceed, or making any payment, you acknowledge that you have read, understood, and agree to these Terms in full.
If you are acting on behalf of a business, insurance company, or property management firm, you represent that you have authority to bind that organization to these Terms.
Section 02
Services
Legacy Restoration WI provides property restoration and related services, which may include but are not limited to:
- Water and flood damage restoration
- Fire and smoke damage restoration
- Storm and wind damage repair
- Mold remediation and prevention
- Roofing repair and replacement
- Structural drying and dehumidification
- Content cleaning and pack-out services
- General reconstruction and finishing
All services are subject to a written scope of work, which will be provided to you prior to commencement. Work outside the agreed scope requires a written change order signed by both parties before work begins.
Section 03
Estimates & Pricing
All estimates provided by Legacy Restoration WI are based on conditions visible at the time of inspection. Estimates are not guaranteed fixed-price quotes unless expressly stated in a signed written contract.
Restoration projects often reveal concealed or secondary damage once work begins. If additional damage is discovered, we will notify you promptly and provide a revised scope. We will not perform work beyond the original estimate without your written authorization, except in circumstances where immediate action is required to prevent further property loss.
Estimates are valid for 30 days from the date of issue unless otherwise noted.
Section 04
Payment Terms
Payment terms will be outlined in your project contract. General terms are as follows:
- Residential projects: A deposit may be required prior to scheduling. The remaining balance is due upon substantial completion of work.
- Insurance claims: If your project is covered by a homeowner's or commercial insurance policy, you are responsible for ensuring timely payment of your deductible and any amounts not covered by insurance. Legacy Restoration WI works directly with many insurance carriers to simplify this process.
- Commercial projects: Net-30 payment terms apply unless otherwise negotiated in writing.
Invoices not paid within the agreed timeframe are subject to a late fee of 1.5% per month on the outstanding balance. In the event of non-payment, Legacy Restoration WI reserves the right to place a lien on the property in accordance with Wisconsin Statutes Chapter 779.
We accept payment by check, ACH transfer, and major credit cards. A processing fee may apply to credit card transactions.
Section 05
Scheduling & Property Access
You agree to provide Legacy Restoration WI and its subcontractors with reasonable access to the property at scheduled times. Failure to provide timely access may result in rescheduling fees or project delays for which the Company is not responsible.
For emergency services, you authorize our team to access the property immediately upon dispatch to prevent further damage. You are responsible for ensuring all animals and valuables are secured prior to our arrival.
We will make reasonable efforts to protect your belongings, furniture, and landscaping during the course of work. However, some disruption is inherent in restoration work and does not constitute negligence.
Section 06
Limitation of Liability
To the fullest extent permitted by applicable law, Legacy Restoration WI's total liability to you for any claims arising out of or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
We shall not be liable for:
- Pre-existing conditions, defects, or damage not caused by our work
- Delays caused by weather, material shortages, or circumstances beyond our control
- Incidental, consequential, or indirect damages, including loss of use of your property
- Damage resulting from your failure to follow post-service care instructions
- Work performed by third parties not engaged by Legacy Restoration WI
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any other liability that cannot be excluded under Wisconsin law.
Section 07
Warranty
Legacy Restoration WI warrants that all work will be performed in a workmanlike manner consistent with industry standards. The specific warranty period applicable to your project will be stated in your written contract.
This warranty does not cover:
- Damage caused by subsequent water intrusion, flooding, or weather events
- Normal wear and tear
- Damage resulting from modifications made by you or third parties after our work is completed
- Issues caused by pre-existing conditions that were disclosed or reasonably discoverable at the time of the project
Manufacturer warranties on materials and products installed during your project are passed through to you where permitted.
Section 08
Insurance
Legacy Restoration WI maintains general liability insurance and workers' compensation coverage as required by the state of Wisconsin. Certificates of insurance are available upon request.
You are advised to maintain your own homeowner's or commercial property insurance policy throughout the duration of any restoration project. Legacy Restoration WI is not responsible for losses not covered by our liability policy.
If your project involves an insurance claim, you are responsible for accurately reporting the claim to your insurer and cooperating with the claims process. We are happy to assist by providing documentation, photos, and scope estimates to support your claim, but the insurance relationship is between you and your carrier.
Section 09
Cancellations & Project Changes
You may cancel a scheduled non-emergency service with at least 48 hours' written notice at no charge. Cancellations with less than 48 hours' notice may be subject to a cancellation fee as specified in your contract.
Once work has begun, you may request to pause or discontinue the project. You will be billed for all work performed, materials ordered or installed, and any mobilization costs incurred up to the point of cancellation.
Change orders must be requested in writing and approved by Legacy Restoration WI before additional work is performed. Verbal change approvals are not binding on the Company.
Section 10
Privacy
Legacy Restoration WI collects personal information (such as your name, address, phone number, and email) solely to perform our services and communicate with you about your project. We do not sell your personal information to third parties.
We may share your information with subcontractors, suppliers, or your insurance carrier as necessary to complete your restoration project. We retain project records as required by Wisconsin law and our internal business policies.
By providing your contact information, you consent to receiving communications from Legacy Restoration WI related to your project, including text messages and emails. You may opt out of marketing communications at any time.
Section 11
Governing Law & Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.
Before initiating any legal action, you agree to contact Legacy Restoration WI in writing to attempt to resolve the dispute informally. We will respond within 10 business days and make a good-faith effort to reach a resolution.
If a dispute cannot be resolved informally, it may be submitted to binding arbitration under the rules of the American Arbitration Association, unless prohibited by applicable law. Each party shall bear its own costs in arbitration.
Section 12
Changes to These Terms
Legacy Restoration WI reserves the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services following any changes constitutes your acceptance of the revised Terms.
For active projects under a signed contract, the Terms in effect at the time of contract signing govern that project unless both parties agree in writing to apply updated Terms.
